Assuming that the 1968 story is not a dream, it is interesting to think about how Max got away.  The only logical explanation is that Max found out what was going to happen and then staged his own death.

There are two scenarios.

It's possible that the police called him and told him about someone calling to turn him in and the phone being backwards narrowed it down to Noodles.  Only at that point did he make his plan but this still seems a little late for putting a plan to allow himself to dissapear in place.

The other option is that he knew at the party what Max was going to do or had already planned to stage his own death. It really doesn't matter which of these is the case ifor this discussion in my opinion.

Both these scenarios bring up the fact that Max's plan involved sacrificing the lives of his two friends since childhood.  The second scenario also adds that knew at the party what he was going to do brings which means that when he toasted with his two friends he was saying goodbye to them knowing that he would be responsible for their deaths.

The second scenario also brings up the possibility that Max tells Noodles to stay behind because he didn't want Noodles to get killed.  He is either doing this out of a perverted friendship or because he wants to ruin Noodles life by giving him this guilt (which parallels Noodles thinking Max had drowned when they are bottlegging as kids).

The first possibiility allows for Max to not already know about Max's betrayal and he would have had him killed except he was beat up so bad that he wasn't able to come to do the job.

Does anyone have any thoughs on this.
