When I saw it in the theater in the early 70s, the final flashback was not as long.  I just always assumed that Mallory killed him because he was betraying him after the torture.  Mallory tells Villega that he only judged someone once.  He had to be referring to that instance and in his way feels guilty about it and seems to be forgiving, or at least understanding Villega's motives and doesn't want to judge him for it too.

I got to see it in Natchez, MS when it was called DYS and not the newer title of a Fistful of Dynamite.
